SCHEDULED MEETING WITH DIRECTOR (HR):

GS, Com.S.P.Jain, OS (North) and Com.B.B.Sharma, Circle Secretary, BSNL CO attended the scheduled meeting for AIBSNLOA with Director (HR) yesterday. Sr. General Manager (Pers), General Manager (Estt), General Managerr (Restg), General Manager (SR) and Jt.General Manager (SR) were present. Status of the issues discussed in the previous meeting was taken up first.

1. REMOVAL OF DISCREPANCIES IN MANAGEMENT TRAINEE RECRUITMENT RULES, 2013:

We expressed our concern that inspite of repeated assurances by Sr. GM (Pers) that clarifications on issues raised by us would be issued soon, nothing has happened. Sr.GM (Pers) informed us that recruitment of Management Trainees has already been postponed for six months, that the entire MT RR is being reviewed based on the issues raised by us and that the MT recruitment will be further postponed.

2. PROMOTION TO SDE, DE AND DGM GRADES IN TELECOM WING AND AO & CAO GRADES IN FINANCE WING:

We expressed concern that all the related court cases are prolonging, leaving the executives in frustration and hundreds of executives retiring every month without getting their due promotion. We were informed that Addl.Solicitor General has been consulted and affidavits in related cases have been filed as per his advice. Corporate office is now directly overseeing handling of cases by circles in various courts. Efforts are being taken to bring all the cases in various CATs to Principal CAT New Delhi. Director (HR) hoped that because of these actions, all the court cases will come to end in the near future. In respect of promotion to DGM (T) grade, we were informed that a decision can be taken only after Supreme Court gives its ruling in the 147 case which will be next heard on 16th February 2016.

3. REMOVAL OF DISCRIMINATION IN GRANT OF JAG SELECTION GRADE SCALE TO ABSORBED GROUP ‘B’ EXECUTIVES TO ENSURE JUSTICE----REGARDING BLATANT VIOLATION OF INSTRUCTIONS OF DOT LETTER DATED 26.08.2008 AND DPE OM DATED 24.12.2012 BY OPERATING IDA SCALE OF RS.17500-400-22300 W.E.F. 01.10.2000 IN PLACE OF RS. 18500-23900:

We were informed that there has been a confusion as to whether the Personnel section or the Establishment section has to process the matter. We were assured that the matter will be sorted out at the earliest and our request for removal of discrimination will be processed.
Then the fresh items were taken for discussion:

1. REVISED EPP/BSNL HR PLAN/CPSU CADRE HIERARCHY:

We explained that Our association has been all along demanding time bound functional promotions upto the level of SG JAG, as was assured at the time of absorption. BSNL Executive Promotion Policy 2007 did not fulfill this assurance and gave only time bound financial upgradation. We pointed out that Hon’ble Principal CAT in OA 1086/2010 on 2.11.2010 observed that, “on a prudent reading and applying the principle of literal and harmonious construction, would indicate that the time bound scales in IDA were made available to the applicants, which, now being reflected as per the impugned order dated 18.1.2007, has not conferred upon the status of the promotional post and are only an eyewash for BSNL employees and are not amounting to promotions. In a promotion, as per the legal methodology, which is a fundamental right of consideration, it is not only the higher pay scale but also assumption of higher post, which are part and parcel of the process of promotion. It would not be a promotion when a person remains in the same post and is only given the scale of the promotion post” and had directed BSNL to reconsider the entire issue and then decide the promotional avenues. After nearly five years after the judgment, BSNL mooted a change in its policy on 14.3.2014, proposing to replace the present time bound financial upgradation and post-based functional promotions with "promotion of Executives to positions in the next higher grade on the basis of merit, efficiency, number of years of service in a grade and suitability for higher posts." But, the draft policy proposed minimum eligibility period of 5 years for promotion to the next grade, implying it will not be time bound. Delinking the availability of posts from promotion and some relaxation in attendant conditions would have made the proposal agreeable and practicable. Later, on 24.12.2014, the Restructuring Cell of BSNL circulated a draft HR Plan for BSNL, based on the recommendations of the Deloitte Consultant and after consultations with the Heads of the Circles. We had submitted our disapproval of the plan in detail vide our letter dated 21.1.2015. Now a committee constituted for the purpose is said to have arrived at certain recommendations. We emphasized our oft-stated position that time bound functional promotions upto SG JAG level, as assured at the time of absorption, alone will offer a solution to the issue. We were informed that the recommendations of the committee may not be accepted in full and that the work of preparing board memo is in progress.

2. EARLY FINALISATION OF SUPERANNUATION BENEFITS TO BSNL RECRUITED EMPLOYEES:

We pointed out that DPE has on 21st May 2014 reiterated that, “The condition of 30% superannuation benefits as prescribed in DPE O.Ms dated 26.11.2008 and 02.04.2009 and as amended from time to time, are to be followed strictly.” We were informed that several calculations on different percentage of contribution by BSNL were worked out and submitted for consideration by Remuneration Committee. Since now, a new Director has taken charge of Remuneration Committee, submission has been again made to him. We requested that the new Director may be apprised of the situation that even after 15 years of formation of BSNL, BSNL has failed to implement a Pension scheme for the BSNL recruited employees and requested to give his views at the earliest.

3. ABOLITION OF DIRECT RECRUITMENT TO DGM GRADE:

We requested that the DGM RR be scrapped and the vacancies be filled through promotion from STS grade. We pointed out to our earlier letters on the subject and the rationale behind our request. Sr.GM (Pers) informed us that our views have been taken into account and it has been decided to do away with direct recruitment to DGM grade. In response to our another query he said that LICE for promotion to DGM grade will also be not held. He agreed that henceforth DGM vacancies should be filled only from eligible executives in STS grade.

4. EXEMPTION FROM APPEARING IN MANDATORY EXAMINATION ON FINANCIAL UPGRADATION IN RESPECT OF ALL PHYSICALLY CHALLENGED EXECUTIVES:

We explained that according to BSNL letter No.400-175/2007-Pers.I (Pt I) dated 2nd August 2010, exemption on acute medical grounds can be considered by the Director (HR) in exceptional cases. Such cases will be submitted to the Dirctor (HR) through the cadre controlling authority in BSNL Corporate Office with necessary recommendation of the CGM concerned and the comments of the IFA. The recommendation from the CGM is understandable, since Director (HR) will not have knowledge of the medical condition of the executives in the Circles. But physically challenged executives, including those visually challenged have already been examined by the competent medical authorities and certified to be physically challenged. In those cases, the certificate should suffice and no recommendation from the CGM should be necessary. We therefore requested that orders may be issued empowering the Director (HR) to grant exemption to physically challenged executives from appearing in the mandatory examination, based on the Certificate issued by the competent medical authority and without the need for recommendation from the CGM concerned, since the CGMs become subjective while recommending a case. We brought to the notice of the Director (HR) that the Heads of some circles refuse to recommend the requests of physically challenged executives. Director (HR) asked Sr.GM (Pers) to talk to the concerned circle Heads and to sort out the issue. She suggested that letter can be written to those CGMs if required. Meanwhile our request for granting exemption to physically challenged executives from appearing in mandatory examination on financial upgradation will be duly considered for issue of necessary instructions.

Recommendations of National Commission for Backward Classes:

NCBC in its report dated 26.10.2015 has stated that the children of MPs should fall under creamy layer and MLAs and MLCs should not be brought under the creamy layer and the Rule of Exclusion should not be made applicable to them. National Commission for Backward Classes in its report dated 26.10.2015 has stated in the proposed schedule category-I, the following in this regard under the heading “Who will fall in the creamy layer”:- “Persons holding constitutional posts/positions and of like nature including Ministers of Central/States, sitting MPs, etc fall in the creamy Layer.” This information was given by the Minister of State, Social Justice & Empowerment, Shri Krishan Pal Gurjar in a written reply to a question in Rajya Sabha here today. BSNL stands tall among all the telecom service providers:

Unprecedented torrential rains triggered massive flooding of Chennai city last week submerging most of the areas in the city, leaving lakhs of people stranded without power, food or water and hundreds dead. The Chennai airport was closed; trains from the Egmore and Central stations were cancelled. National Disaster Response Force had to be pressed into service to rescue stranded people. There was large scale communication failure with flood engulfing BTSs and exchanges. But BSNL stood tall providing the much needed communication to people direly in need of it. Anyone with a BSNL mobile connection was seen as godsend with neighbours queuing up to talk to their near and dear. Even the affected MSC and Broadband network of BSNL were restored within 2 days, due to the dedicated and exemplary work of BSNL officers and employees of Chennai Telephone District. BSNL alone came to the rescue of the customers by announcing free calls and data usage for one week. BSNL has once again proved that it alone connects India even at times of such natural calamities. BSNL ZINDABAD!

'US-based consultant D&M has submitted its final report on the gas dispute between ONGC and Reliance Industries, establishing that natural gas worth over Rs 11,000 crore has migrated from idling KG fields of the state-owned firm to the adjoining KG-D6 block.
