According to calculations based on All India Consumer Price Index for Industrial workers for December 2015 (269), January 2016 (269) and February 2016 (267), there is no increase in IDA w.e.f. 1.4.2016 which will remain at 112.4%.

1.Promotion to DGM (T) on adhoc basis:

Sr.GM (Pers) informed us that the file has been submitted to CMD for approval after clarifying certain points raised by Director (HR). Promotion orders are likely to be issued tomorrow (Thursday) for about 400 executives of Recruitment Year 1980, who qualified for TES Group B in 1988 and were promoted to STS grade in the year 2010. We requested Sr.GM (Pers) to consider around 100 executives who became STS in the year 2013 by giving relaxation in qualifying service. Sr. GM (Pers) has agreed to examine our request. We have requested that if they could not be considered now, they can be considered for promotion atleast in the near future, as and when they will be completing three years service in STS grade.

2.Revision of pay scale of Rajbhasha Adhikari and restructuring of Hindi cadres:

Sr. GM (Pers) informed us that a Note is under preparation for consideration of Management Committee on these issues.

3.Implementation of CPSU cadre hierarchy:

We reiterated our stand stating that we have given our views on the purported proposals of Personnel Section. Sr.GM (Pers) said that he will go through our letter and consider the matter.

'It is learnt that these proposals, if implemented, will double the wait period in getting the first promotion and it will take minimum 17 years to reach DE scale. Although the latest committee had recommended time bound functional promotion every five years upto DE level, the Personnel section is said to have proposed to cap the number of DE/AGM posts. The Personnel section reportedly has recommended further tightening of benchmark in APAR. As suggested by the Deloitte Consultant and later modified based on the Heads Of Circles opinion, JTO, SDE and Sr.SDE cadres are proposed to be clubbed and asked to report to DE/AGM. Even before a decision is taken on the proposals, orders have been issued asking JTOs and SDEs to report to DE/AGM, which is going to have disastrous impact on hierarchy management.'   Read More

'The DEs/AGMs who are under consideration for promotion to DGM (T) grade now were promoted to the STS grade based on the then applicable seniority list, which has been modified now as per the directions of Supreme Court. Some of them may not have the required qualifying service of 4 years in STS grade while their juniors (according to revised seniority) promoted earlier to them as STS will have the qualifying service. Promoting these juniors, leaving out the seniors according to the restored seniority lists 1 to 17 will result in a serious discrepancy.'   Read More

GS and Com. P.C. Rastogi, AGS met Jt. GM (Pers) yesterday and discussed about further issue of promotion orders from DE/AGM to adhoc DGM. Jt. GM (Pers) informed us that all efforts are being made for issue of promotion orders for about 600 vacancies before 31st March 2016. Work has already been commenced, VC has been called for in respect of all the eligible DE/AGM level executives and all circles have been requested to send the APAR of eligible executives immediately. We requested Jt. GM to ensure issue of the promotion orders at the earliest. We also requested to him to ensure issue of pending own cost transfer / retention request of the executives. Jt. GM (Pers) told us that all the pending requests are under consideration and orders will be issued soon.

Special General Body meeting of UP West Circle of AIBSNLOA:

GS attended the special General Body meeting of UP (W) circle at Meerut last week along with OS (North) Com.S.P.Jain. CS UP (W) welcomed the gathering. Deliberations were mainly about court cases pending in various courts like 206 case / 147 case at Hon'ble Supreme court of India, Stay on promotion by Hon'ble High Court of Punjab and Haryana which is coming on hearing on 14th of March 2016, stay on promotion from JTO to SDE by High Court of Kerala. Detailed discussions were held on seniority according to Rule 206. There were discussions about SWAS programme, increase in mobile connection during the month, various HR issues like cadre hierarchy, Pension to BSNL recruited employees and replacement of E1A and E2A by E2and E3 scale etc. Before the meeting GS, OS and Shri A.K. Sharma VP met CGM UPW and discussed about various HR and development issues. CGM UPW explained the various initiatives taken by him for increase in revenue of UPW. He also detailed about development activities initiated by UPW in the last 2-3 months. CGM UPW also appreciated the activities of AIBSNLOA in UPW telecom circle. We promised CGM UPW AIBSNLOA will continue to co-operate with UPW management in all the development activities.

"In view of representations received, the government would like to do a comprehensive review of this proposal and therefore I withdraw the proposal," Jaitley said in a suo motu statement in Lok Sabha, amid cheering from his party colleagues in the Parliament. Reservation in Promotion:

The instructions issued by Department of Personnel & Training provide for reservation in promotion to persons belonging to Scheduled Castes (SCs) and Scheduled Tribes (STs) in posts in the Central Government upto the lowest rung of Group 'A'. These instructions are also being implemented by Central Public Sector Undertakings, wherever reservation in promotion is applicable.
The Supreme Court in its judgment dated 19.10.2006 in the matter of M. Nagaraj & Others vs. Union of India and Ors., while upholding the validity of some of the Constitutional Amendments, observed that the concerned State will have to show in each case the existence of compelling reasons, namely, backwardness, inadequacy of representation and overall efficiency of administration before providing reservation in promotion. In order to provide impediment free reservation in promotion to SCs and STs, the Constitution (One Hundred and Seventeenth Amendment) Bill, 2012 was introduced in Rajya Sabha in September, 2012. The Bill was passed by the Rajya Sabha on 17.12.2012 and transmitted to the Lok Sabha for consideration and passing. The Bill could not be considered in the Lok Sabha and lapsed on the dissolution of 15th Lok Sabha. The issues emanating from the Supreme Court judgment in M. Nagaraj case are under examination.
This was stated by Minister of State for Personnel, Public Grievances and Pensions and Minister of State in the PMO Dr. Jitendra Singh in a written reply to a question by Shri Kaushal Kishore in the Lok Sabha today.(PIB)

Recovery of wrongful / excess payments made to Government servants:

"The Hon'ble Supreme Court while observing that it is not possible to postulate all situations of hardship which would govern employees on the issue of recovery, where payments have mistakenly been made by the employer, in excess of their entitlement has summarized the following few situations, wherein recoveries by the employers would be impermissible in law:-
(i) Recovery from employees belonging to Class-III and Class-IV service (or Group 'C' and Group 'D' service).
(ii) Recovery from retired employees, or employees who are due to retire within one year, of the order of recovery.
(iii) Recovery from employees, when the excess payment has been made for a period in excess of five years, before the order of recovery is issued.
(iv)Recovery in cases where an employee has wrongfully been required to discharge duties of a higher post, and has been paid accordingly, even though he should have rightfully been required to work against an inferior post.
(v) In any other case, where the Court arrives at the conclusion, that recovery if made from the employee, would be iniquitous or harsh or arbitrary to such an extent, as would far outweigh the equitable balance of the employer's right to recover."   Read More

"Where an Executive could not complete the requisite mandatory training within 2 years period from the date of upgradation due to administrative restraints and not for any reason directly attributable to him, the 2nd increment due to him be allowed as a special case in relaxation of para 1.0 (I)(f) of EPP-2007 provided the Executive concerned completes the mandatory training in the first attempt itself after grant of such relaxation.
