  • 18.09.2013:CHQ writes to the Secretary, DoPP&W on merger of 78.2% IDA with basic pension benefit to the absorbed BSNL Pensioners:'The DoT proposal to allow the benefit only w.e.f. 10.06.2013 seeks to create categories among the post-2007 retirees, allowing the benefit to those who retired on or after 10.06.2013 and denying the benefit to those who retired between 1.1.2007 and 9.6.2013. This amounts to patent discrimination and is unlawful.' Read More...

  • 21.08.2013:CHQ writes to Secretary, DoT on Benefit of merger of 50% DA with Basic Pay w.e.f. 01.01.2007, effectively amounting to 78.2%, for the purpose of fitment and pay fixation in the revised pay scales:'No one appeared to have realized that the fitment benefit of 78.2% was not related to profit/loss of the company, but related to the compensation paid to the employees, pensioners and family pensioners for rising prices of essential commodities.'   • 08.08.2013:CHQ writes to CMD BSNL requesting reallotment to Chennai TD on promotion as DE (Adhoc):'We are of the firm opinion, sir, that if the 43 vacant posts {19 vacant as on date plus the 24 (I5% of the sanctioned strength i.e. 161)} are filled up strictly on merit and seniority basis, this will prevent mass scale exodus of experienced and senior Executives from Chennai thereby fulfilling needs of the Chennai Telephones Administration also and pave way for a smooth and uninterrupted working.   • 08.08.2013:CHQ writes to CMD BSNL on Non-resolution of long pending issues of BSNL Executives - Finalization of standard E2 and E3 pay scales for JTOs and SDEs respectively and their equivalent cadres:'We are of the view that openness, positive approach and willingness to listen to and understand the problems are the need of the hour. Management needs to settle genuine issues without seeing as to who raised the issue and without waiting for it to precipitate.   • 08.08.2013:CHQ writes to Director (HR) requesting to review posting on promotion to SDE (T) grade under 33% competitive quota:'One category is those who have already served in tenure circles and the other one is those who have only recently come on transfer to the present circle under Rule 8 after serving in other circles on their initial posting as JTOs. The requests of these JTOs for posting in the circle of their choice may also be favourably considered and modified orders may be issued. ' Read More...

  • 07.08.2013:CHQ writes to CMD BSNL on Revised fixation benefit amounting to 78.2% of pre-revised basic pay as on 1.1.2007 for those who retired after 1.1.2007 but before 10.6.2013:'All the retired Executives and Non-executives belonging to this category are fervently waiting for their pay being re-fixed with fitment benefit of 78.2% as on 1.1.2007, since their last pay drawn will automatically get changed. They will, therefore, be entitled to get additional benefit as are admissible based on their revised last pay drawn.' Read More...

  • 01.08.2013:CHQ writes to CMD BSNL requesting initiation of process of promotion of DGM and DE on adhoc basis to fill remaining vacancies:'However we would like to draw your kind attention to the fact that still around 300 posts in DGM grade and 1000 posts in DE grade remain unfilled. At an average, fifty to sixty DGMs/DEs retire every month, increasing the resultant vacancies in these grades.' Read More...

  • 26.07.2013:CHQ writes to GM (Pers) for modification in posting orders on promotion to DE on adhoc basis:'The problem of shortage of SDEs in Tamilnadu, Karnataka and Chennai Telephones Circles is particularly of immediate concern, as also 100% of the DE vacancies in these circles have not been utilized for posting promoted officers. The circles where these officers have been posted to, will also not be benefitted unless they join their new assignment. The expenditure to BSNL on transfer benefits to these 450 officers, roughly amounting to Rs.450,00,000/- may not be a purposeful one, in the present financial state of BSNL.' Read More...

  • 26.07.2013:CHQ writes to Sr.GM (Est) on Regular appointment as JTOs – case of TTAs officiating as JTOs:'We would like to point out that, BSNL vide its letter No. 3-34/2013/Pers-IV dated 26.6.2013, in a brief sent to the Circles for defending court cases filed by officiating JTOs to quash the notification for LDCE of JTO/Stay of the Result/Regularisation, has submitted in Para (i) that, “Since Contempt Petition is pending in Hon'ble High Court of Punjab and Haryana, it is not possible to regularize officiating JTO's till final outcome of the Contempt Petition.”' Read More...

  • 26.07.2013:CHQ writes to CMD BSNL on Discrepancy in BSNL MS RR in respect of SDE grade of Civil/Electrical/Architecture wing in BSNL - Denial of promotion to EE grade in respect of non-graduates:'Now, the Hon’ble PCAT, Delhi, in OA-2651/2012 has delivered a judgment on 26.4.2013 that the applicants in the OA may be considered for grant of the benefit in terms of Government of India Instructions dated 26.05.1977 by which diploma in Engineering with ten years technical experience has been recognized as equivalent to degree in Engineering.'   • 09.07.2013:CHQ writes to CMD regarding the Revised results of LDCE for promotion to SDE (T) held on 4.3.2012 :'We would therefore request you to kindly bestow your immediate attention to this issue and cause inclusion of the names of 119 JTOs who had been declared successful vide BSNL letter dated 4.7.2012 and are not finding a place in the revised list of successful candidates circulated vide BSNL letter dated 28.6.2013 and to thus render justice to them.'   • 07.06.2013:CHQ writes to Group Of Ministers looking into revival strategy for BSNL & MTNL:'BSNL is now paying service tax on the amount for which bills have been raised. It is a krrown fact that all the bills raised do not end in realization of the amount billed. Thus BSNL has to pay more than the service tax it collects from its customers. Hence it should be ensured that BSNL pays service tax only on the amount realised througb bills.' Read More...

  • 07.06.2013:CHQ writes to Director (HR) on early convenlng of DPC for promotion to DE Adhoc and diversion of more STS posts from MT quota to Seniority cum fitness quota:'We would also like to draw your kind attention to the fact that out of the total 5400 STS posts (27OO ppsts are meant for seniority cum fitness quota and the other 27OO posts are meant for MT quota),only 2000 STS vacancies have been filled till date by seniority cum fitness basis, including the 600 regular posts. Therefore 34OO posts still remain unfilled. Also on an average around 80 DEs are retiring every month adding to the number of vacant posts and the acute shortage of DEs in the field units have a telling effect on the services. Even after diversion of 1100 posts from MT quota, 1600 posts under MT quota still remain vacant.' Read More...

  • 29.05.2013:CHQ writes to CMD BSNL regarding discrepancy ln BSNL MSRR in respect of DE grade of Civil/Electrical/Architecture wing in BSNL - Denial of Promotiotn to SDE (Civil/Electrical/Architecture) in the Grade of STS in respect of non-graduates:'In the revised guidelines too it has been stipulated under Para 3.9 that “only basic qualification in the discipline may be insisted upon. For example, if a degree in Civil Engineering is the qualification prescribed for direct recruits, the promotees may be required to possess at least a Diploma in Civil Engineering.”' Read More...

  • 29.05.2013:CHQ writes to CMD BSNL requesting reconsideration of its orders on restrictlon on the usage of service/residential telephone connection to reduce lnterconnect usage charges:'The Executives are paying towards the calls made in excess of the free call limit prescribed.   • 21.05.2013:CHQ writes to CMD on Non- grant of First Tlme Bound Financlal Up-gradation due on O1.1O.2OO4 under TBP Pollcy 2OO7 to the BSNL Executives against whom no Vlgilance Case was pending as on the due date.:'Since no clarification has been issued on this so far, the issue of time bound upgradation in respect of mqjor penalty cases emanating after the due date remain unresolved in some circles.   • 14.05.2013:CHQ writes to Chairman BRPSE on 78.2%:'As per the operational modalities for BRPSE, on reference by the administrative Ministry, other loss making CPSEs can be considered by BRPSE if it is of the opinion that revival/restructuring is necessary for checking the incipient sickness (incurring loss for two consecutive years) and making the CPSE profitable, keeping the industry specific business environment in view. Thus it would be seen that BRPSE can advise the CPSE on revival/restructuring strategies and not on implementing earlier directions of DPE on pay related matter.' Read More...

  • 06.05.2013:CHQ writes to CMD on Pay fixation under FR 22 (I) (a) (1) instead of FR 35 for TTAsofficiating as JTOs:'We earnestly request you to kindly intervene and to cause issue of orders granting the benefit of pay fixation under FR 22 (1)(a)(i) to all the TTAs officiating as JTOs, subject to the condition that the benefit will be reversed in case the writ petitions by BSNL before Kerala High Court is allowed. As far as the retiring TTAs are concerned, an undertaking, similar to the one taken from retiring officers who got their pay in IDA scale fixed from the date of their promotion after 1.10.2000, can be obtained from them.'   • 15.04.2013:CHQ writes to CMD requesting grant of exemption from appearing in the LDCE for promotion to JTO -case of TTAs who have passed the screening test held in 2OOO:'We are worried over the inhuman attitude with which the issue is being handled after exploiting the services of these TTAs for years together by ordering them to officiate in JTO vacancies. Now, asking them to appear in the examination after they have completed JTO Phase I training and have worked for so many years as JTOs, is neither fair nor justified.   • 26.03.2013:CHQ writes to Secretary DoT regarding deputation of unabsorbed ITS officers in BSNL for a further period of 10 years:'Apart from the above, the decision to allow deputation to the unabsorbed ITS Group A Officers for a further period of 1O years will cause serious demoralization, frustration and de-motivation to the BSNL's own Officers, since the deputationists will occupy the posts sanctioned against BSNL's assets which otherwise are the promotional posts of BSNL Officers. In case of JAG level posts alone, 181 number of posts of DGM are being held by the deputationists - thus blocking the promotion avenues of the eligible BSNL Executives.   • 21.11.2012:CHQ writes to CMD regarding grant of five advance increments to departmental JAOs who passed the JAO Part II examination held in January 2010: 'During our meeting with GM (Estt) on 31.7.2012 we were informed that the Committee constituted for considering the issue has recommended grant of advance increments to remove the anomaly and that the Management Committee will consider the recommendation. We have been waiting patiently for more than three months for the Management Committee to take a view on the issue. But no decision appears to have been taken in this regard till date. We therefore request your kind intervention in this matter and to ensure that the instructions contained in your office circular dated 26.10.2010 referred to above are implemented in letter and spirit so as to end discrimination.'   • 29.10.2012:CHQ writes to CMD on Non- grant of 1st time Bound Financial up-gradation due on 01.10.2004 under TBP Policy 2007 to the BSNL Executives against whom no Vigilance Case was pending as on the due date: 'Therefore, the stipulation in Para (c) of the BSNL letter dated 20.9.2012 that, "Disciplinary cases of minor penalty, emanating beyond the due date of time bound upgradation, may not affect the grant of time bound upgradation" implying that disciplinary case of major penalty emanating beyond the due date may affect the grant of time bound upgradation, is not only contradictory to Para (b) but also to existing guidelines on sealed cover procedure. No judgment of any Court has advised such discrimination/differentiation between minor and major penalty cases emanating after the due date.' Read More...

  • 01.10.2012:AIBSNLOA CHQ's email to Cabinet Secretary on DoT proposal to keep non-optee Group A officers on permanent deputation/foreign service/encadrement in BSNL: Immediately after learning on 26.9.2012 that the Committee of Secretaries (COS) was to meet on 28th September 2012 to consider DoT's proposal for keeping the non-optee Group A officers on permanent deputation/foreign service/encadrement in BSNL, General Secretary has sent email to Cabinet Secretary with copies marked to other Secretaries, enclosing the earlier letter addressed to PM, with a view to draw their immediate attention to our views, before the COS meeting took place.   • 21.09.2012:CHQ writes to Prime Minister on Implementation of orders of Hon’ble High Court of Delhi directing BSNL to relieve all those Group A officers who have not opted for Absorption in BSNL: 'Apart from the ethical issues involved, such proposal will not stand legal scrutiny since DPE vide its letter No.18(6)/2001-GM-GL-77 dated the 28th December 2005, has reiterated that “deputation of Government officers including those belonging to Defence Services, to posts (whether Board level or below Board level) in Central Public Sector Enterprises (CPSEs) is not permitted”, except “for the posts of Chief Executives and Regional/Zonal Chiefs of CPSEs.” In respect of encadrement, DoPT vide its Letter No. 11031/6/87-AIS(II), dated 20.4.1987 has emphasized that, “The question whether the posts in Public Sector Undertakings could be encadred in the AIS has been examined further and the Government of India have been advised that such posts cannot be encadred in the cadre schedules of the All India Services as cadre posts.”' Read More...

These officers got their regular promotion after 1.1.2007 as JTO and their pay has been fixed at Rs.16400/- i.e. at the minimum of E1 scale.   • 06.04.2009: CHQ writes to Secretary, Ministry of Heavy Industries & Public Enterprises on removal of aberrations due to the proposal for introduction of non-standard scales in BSNL: 'In its latest O.M. dated 02.04.2009 (vide Para 2.vi), DPE has clearly instructed against introduction of any intermediary scales and has further stressed that “If there has been any aberrations, they need to be corrected.”  In this connection we are to submit that in Bharat Sanchar Nigam Limited, there are at present aberrations in respect of two Executive grades at the level of Junior Telecom Officers/Junior Accounts Officers/equivalent cadres and Sub Divisional Engineers/Accounts Officers/Equivalent cadres. They are placed in the intermediary pre-revised IDA pay scales of Rs 9850-250-14600  and Rs 11875-300-17275 respectively. Though there is an opportunity for BSNL and the Department of Telecommunications i.e. the Administrative Department to correct these aberrations by placing them in revised E-2 and E-3 grades respectively, it has been proposed to grant them intermediary replacement IDA pay scales and thereby to continue with the present aberrations.' But this minimum expenditure on the part of BSNL for the highly qualified new entrants will give it back a big gain. BSNL need to retain the services of these Executives and ensure that they are not forced to migrate to other Organization in search of higher emoluments. BSNL is also proposing to recruit Management Trainees. With the low pay scale offered, no qualified personnel would tend to join or stay with BSNL for a longer period.   • 08.12.2008 (1300 Hrs):CHQ writes to Shri.Santosh Mohandev, Minister for Heavy Industries and Public Enterprises requesting review of certain decisions on important issues pertaining to Govt. decision on recommendations of the 2nd Pay Revision Committee:' The orders issued by Department of Public Enterprises vide its No 2(70)/08-DPE(WC) dated 26th November 2008 on the above matter has created serious discontentment among the Executives of all CPSEs in general and our members in particular. It is observed that many significant recommendations of the 2nd Pay Revision Committee have not been accepted thereby denying the long awaited justice to the Executives. We also find that even in regard to fitment benefit, the Government has treated the Executives of CPSEs and Government Employees differentially. We would, therefore, like to earnestly appeal to you and through you other authorities to reconsider at least the following few decisions.   • 05.08.2008:CHQ writes to CMD on BSNL Executives' Promotion Policy vis-a-vis Recruitment of Management Trainees:
    "Best solution lies if the BSNL Board takes out bare minimum number of posts at STS level per year as per requirement subject to the ceiling that number of Management Trainees will be restricted to 30% of the total posts. Whatever number of MTs are  recruited in a year, 50% of them shall be from internal candidates and rest 50% from external candidates."
    "Best policy is to allow carry over of unfilled quota of posts of any stream to the subsequent recruitment year’s quota of posts of same stream. However, if some of these posts still remain unfilled at the end of second recruitment year, the same should be transferred for the promotion of the Departmental  (seniority quota) candidates."

    "Recruitment of MTs for HRM Stream: There has to be recruitment against 50% posts of MTs from eligible internal candidates."
    "Age limit for internal candidates need to be raised at least upto 45 years for a period of next 8 years since the optees have so far lost these many years in absence of BSNL’s inability to put the promotion policy in place from the date of their absorption (1.10.2000)."
    "Pay scale not to be a bar for internal candidates."
    "According to the prescribed qualifications as at present, the Executives from Electrical, Civil, Telecom Factory and Architectural Wing are having no opportunity to enter the cadre of Management Trainees.
