Amendment to CCS (Leave) Rules, 1972:

'In the Central Civil Services (Leave) Rules, 1972, for rule 48, the following rule shall be substituted, namely:- " 48, Special Leave connected to inquiry of sexual harassment - Leave upto a period of 90 days may be granted to an aggrieved female Government Servant on the recommendation of the Internal Committee or the Local Committee, as the case may be, during the pendency of inquiry under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 and the leave granted to the aggrieved female Government Servant under this rule shall not be debited against the leave account".'   View DoP&T Notification

'It should be ensured that the aggrieved women are not victimized in connection with the complaints filed by them. For a period of five years after a decision in a proven case of sexual harassment, a watch should be kept to ensure that she is not subjected to vendetta. She should not be posted under the Respondent, or any other person where there may be a reasonable ground to believe that she may be subjected to harassment on this account. In order to review and revise the existing structure of the emoluments of CPSE Executives, Government of India has appointed Third Pay Revision Committee headed by Retired Justice Satish Chandra. Recovery of wrongful / excess payments made to Government servants:

"The Hon'ble Supreme Court while observing that it is not possible to postulate all situations of hardship which would govern employees on the issue of recovery, where payments have mistakenly been made by the employer, in excess of their entitlement has summarized the following few situations, wherein recoveries by the employers would be impermissible in law:-
(i) Recovery from employees belonging to Class-III and Class-IV service (or Group 'C' and Group 'D' service).
(ii) Recovery from retired employees, or employees who are due to retire within one year, of the order of recovery.
(iii) Recovery from employees, when the excess payment has been made for a period in excess of five years, before the order of recovery is issued.
(iv)Recovery in cases where an employee has wrongfully been required to discharge duties of a higher post, and has been paid accordingly, even though he should have rightfully been required to work against an inferior post.
(v) In any other case, where the Court arrives at the conclusion, that recovery if made from the employee, would be iniquitous or harsh or arbitrary to such an extent, as would far outweigh the equitable balance of the employer's right to recover."   Read More

DoPT has circulated its earlier guidelines that the Government employees are required to book the air tickets directly from the airlines (Booking counters, website of airlines) or by utilizing the service of Authorized Travel Agents viz. 'M/s Balmer Lawrie & Company', 'M/s Ashok Travels & Tours' and 'IRCTC' (to the extent IRCTC is authorized as per DoPT O.M. No. 31011/6/2002-Est(A) dated 02.12.2009) while undertaking LTC journey(s) and that Vide DoPT's O.M. 31011/5/2014-Estt.(AIV) dated 24.09.2014, the web-portal of these authorized travel agents will also be treated as an acceptable mode for purchase of air tickets on LTC subject to the conditions stated vide Department of Expenditure's O.M. Verification of qualifying service after 18 years service and 5 years before retirement:

These rules have been amended subsequently and as per the existing provisions, a certificate regarding qualifying service is required to be issued by the HOO after completion of 18 years of service and again 5 years before the date of retirement of an employee. While repeatedly taking up the issue of discrpeancy in BSNL MS RR in respect of SDE grade of Civil/Electrical/Architecture wing in BSNL, denying promotion to EE grade in respect of non-graduates, through our letters dated 29.5.2013, 26.7.2013 and 28.3.2014, we had pointed out a Principal CAT judgment on 26.4.2013 that the applicants in the OA may be considered for grant of the benefit in terms of Government of India Instructions dated 26.05.1977 by which diploma in Engineering with ten years technical experience has been recognized as equivalent to degree in Engineering.   [View CHQ letter dated 28.3.2014]    DoT challenged the judgment of PCAT in High Court of Delhi. Delhi High Court dismissed the appeal on 5.8.2014. The Minutes of the 23rd meeting of SCOVA reveals that DoT has since changed its earlier stand stated in its Action Taken Report on the Minutes of 22nd meeting of SCOVA and has said that the matter has been re-examined by them and a fresh proposal will be sent to DoP&PW for consideration before 30.09.2013. In the ATR, DoT had said that 'The proposal for revision of pension/ family pension of pre-2007 and post-2007 BSNL IDA pensioners/family pensioners by allowing the benefit of merger of 50% of DA/DR effectively amounting to 78.2% as on 01.01.2007 w.e.f 10.06.2013 based on the pay revision of BSNL serving employees w.e.f. 10.06.2013 is under consideration.'  Read More
