DPE has issued orders revising the rate of IDA to the executives and non-unionised supervisors of CPSEs (2007 pay revision) from 159.9% to 170.5% w.e.f. 01.07.2021. The increase subsumes the additional installments arising on 01.10.2020, 01.01.2021 and 01.04.2021. Government of India has approved mandatory utilisation of capacities of BSNL and MTNL by all Ministries/Departments of Government of India/Central Public Sector Undertakings/autonomous bodies etc under Central Government. The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has given its approval for hiving off mobile tower assets of Bharat Sanchar Nigam Limited (BSNL) into a separate company, fully owned by BSNL. This approval authorizes BSNL to monetize its telecom tower infrastructure with the formation of a separate subsidiary company. There are around 4,42,000 mobile towers in the country out of which more than 66,000 mobile tower are of BSNL. Clarification regarding admissibility of flexi-fare in Shatabdi/Rajdhani/Duronto trains while availing LTC:

DoP&T has clarified that "flexi fare (dynamic fare) applicable in Rajdhani/Shatabdi/Duronto trains shall be admissible for the journey(s) performed by these trains on LTC. This dynamic fare component shall not be admissible in cases where a non- entitled Government servant travels by air and claims reimbursement for the entitled class of Rajdhani/Shatabdi/Duronto trains. DPE asks DOT to examine the views of AIBSNLOA communicated to DPE through its letter dated 16.3.2017 on 'Non-applicability of affordability clause recommended by 3rd PRC to BSNL' and to furnish its (DoT's) comments to DPE:

AIBSNLOA had written to DPE vide its letter No.AIBSNLOA/CHQ/2017/17 dated 16.3.2017 explaining in detail that the recurrent loss to BSNL in the past few years is due to inadequate investment in infrastructure expansion in recent years leading to delay in expansion of mobile netework and the company was also made to pay market rate of Rs.18500.38 crore for both 3G and BWA spectrum and pointing out that BSNL revenue has been increasing during the past three years with 14.92% in 2015-16 and BSNL is likely to make profit in 2018. AIBSNLOA had requested that 'Considering the National and Strategic importance of BSNL which is implementing the social obligations of the Government, it is necessary that the affordability condition is not made applicable to BSNL.'

Amendment to CCS (Leave) Rules, 1972:

'It should be ensured that the aggrieved women are not victimized in connection with the complaints filed by them. For a period of five years after a decision in a proven case of sexual harassment, a watch should be kept to ensure that she is not subjected to vendetta. She should not be posted under the Respondent, or any other person where there may be a reasonable ground to believe that she may be subjected to harassment on this account. 'Questions have been raised by the Ministries and Departments asking whether this is applicable in the case of 'Censure' also. In order to review and revise the existing structure of the emoluments of CPSE Executives, Government of India has appointed Third Pay Revision Committee headed by Retired Justice Satish Chandra. Recovery of wrongful / excess payments made to Government servants:

"The Hon'ble Supreme Court while observing that it is not possible to postulate all situations of hardship which would govern employees on the issue of recovery, where payments have mistakenly been made by the employer, in excess of their entitlement has summarized the following few situations, wherein recoveries by the employers would be impermissible in law:-
(i) Recovery from employees belonging to Class-III and Class-IV service (or Group 'C' and Group 'D' service).
(ii) Recovery from retired employees, or employees who are due to retire within one year, of the order of recovery.
(iii) Recovery from employees, when the excess payment has been made for a period in excess of five years, before the order of recovery is issued.
(iv)Recovery in cases where an employee has wrongfully been required to discharge duties of a higher post, and has been paid accordingly, even though he should have rightfully been required to work against an inferior post.
(v) In any other case, where the Court arrives at the conclusion, that recovery if made from the employee, would be iniquitous or harsh or arbitrary to such an extent, as would far outweigh the equitable balance of the employer's right to recover."   Read More

'Department of Posts has extended the "elPO" (electronic Indian Postal Order) service to Indian citizens residing in India also w.e.f. 13.02.2014, for purchasing Indian Postal Order electronically by paying a fee online through e-Post Office Portal. DoP&T has clarified that, in the case of a review DPC, where a junior has been promoted on the recommendations of the original DPC, the official would be considered for promotion if he/she is clear from vigilance angle on the date of promotion of the junior, even if the provisions of para 2 of DoPT OM dated 14.9.92 get attracted on the date the actual promotion is considered.  View clarification

New rule lowers HRA exemption claim limit:

'The central government has lowered the exemption limit for reporting the rent received. Salaried taxpayers claiming HRA exemption and paying a rent of over Rs 1 lakh per year have to give landlord's PAN (permanent account number). Till now, if the total rent paid was less than Rs 15,000 a month there was no need to submit the landlord's PAN details. The new rule effectively lowers the rent limit from Rs 15,000 a month to Rs 8,333 per month for claiming HRA exemption without making any disclosures.'  Read More

Fitment benefit of 78.2% IDA for pension revision of BSNL Pensioners:

The Minutes of the 23rd meeting of SCOVA reveals that DoT has since changed its earlier stand stated in its Action Taken Report on the Minutes of 22nd meeting of SCOVA and has said that the matter has been re-examined by them and a fresh proposal will be sent to DoP&PW for consideration before 30.09.2013. In the ATR, DoT had said that 'The proposal for revision of pension/ family pension of pre-2007 and post-2007 BSNL IDA pensioners/family pensioners by allowing the benefit of merger of 50% of DA/DR effectively amounting to 78.2% as on 01.01.2007 w.e.f 10.06.2013 based on the pay revision of BSNL serving employees w.e.f. 10.06.2013 is under consideration.'  Read More
